Terms of Use

1. Agreement

These Terms govern use of the Precision Peaks Custom Terrain Studio and orders created through it. By using the Studio and checking the agreement box before checkout, you agree to these Terms. You must be at least 18 years old or the age of majority where you live. Otherwise, a parent or legal guardian must place the order and accept these Terms.

2. Purpose and terrain information

The Studio is a design and visualization tool for ordering custom CNC-carved terrain artwork. Maps, place names, elevations, boundaries, trails, and terrain models may come from public or third-party sources. When source data contains gaps, the Studio may interpolate values or blend alternate or lower-resolution data. These processes can smooth, shift, simplify, or omit features.

Studio maps, elevations, boundaries, previews, and production data are approximate. They are not surveys and must not be used for navigation, engineering, property boundaries, aviation, avalanche assessment, emergency planning, or another safety-critical use.

3. Your design and physical carving

You are responsible for reviewing the selected area, orientation, scale, exaggeration, plaque wording, spelling, and other options before ordering. A digital preview is representative and is not a photograph or guarantee of the exact finished appearance.

Every carving is made from natural wood. Color, grain, knots, checks, mineral streaks, beetle-kill staining, and other natural characteristics will vary. CNC tooling, sanding, finishing, source resolution, and reasonable manufacturing tolerances may soften, simplify, or omit fine terrain features. Ordinary natural variations alone are not defects; this does not exclude shipping damage or failure to match agreed specifications.

4. Customer-provided content

You represent that you own or have permission to use any plaque text, names, tracks, boundaries, artwork, or other content you submit. You retain any rights you hold in that content and grant Precision Peaks a limited license to store, reproduce, adapt, and use it as needed to preview, manufacture, fulfill, document, support, or reproduce your order. Personalized content will not be used in advertising without separate permission.

Precision Peaks may reject or cancel a design that appears unlawful, infringing, abusive, unsafe, or impractical to produce.

5. Orders, payment, and delivery

Checkout, payment, taxes, and shipping are facilitated through Squarespace and its payment providers. An order is accepted when Precision Peaks issues an order confirmation. If a design cannot be manufactured reliably, Precision Peaks may request approval for changes or cancel and refund the affected order.

Production and delivery dates are estimates based on carving size, quantity, and current workload. Returns, cancellations, and other purchase policies are described in the Precision Peaks Shop Policies and remain subject to applicable law.

If Precision Peaks cannot ship within the represented time, it will provide notice and the delay, cancellation, and refund options required by applicable law.

6. Studio ownership

Precision Peaks owns or licenses the Studio's copyrightable software, interface, graphics, templates, documentation, and original content. Public-domain facts and data, third-party content, and customer-provided content are excluded from that claim.

Unless separately agreed in writing, internal meshes, STL files, toolpaths, and other production files remain Precision Peaks manufacturing materials and are not included with purchase of a physical carving. Screenshots of your own design may be shared for personal, noncommercial use.

7. Third-party services and availability

The Studio depends on mapping, elevation, hosting, storage, checkout, and other third-party services. Precision Peaks may update, suspend, or discontinue features and cannot promise uninterrupted or error-free availability. Required source attribution and third-party rights remain with their respective providers.

Current terrain and map sources may include USGS 3DEP, the Mapzen Terrain Tiles global elevation mosaic, OpenTopoMap, and OpenStreetMap contributors. Available providers and coverage may change.

8. Disclaimers and limits

To the fullest extent permitted by law, the Studio and its terrain information are provided as available without a guarantee of accuracy, completeness, or uninterrupted operation. Nothing in these Terms excludes a statutory warranty, remedy, or consumer right that applicable law does not allow Precision Peaks to exclude.

To the fullest extent permitted by law, Precision Peaks will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of the Studio or reliance on terrain information. Aggregate direct liability concerning a design or order will not exceed the amount paid for the affected order. These limits do not apply to gross negligence, willful misconduct, personal injury, or liability that cannot legally be limited.

9. Governing law, changes, and contact

These Terms are governed by Colorado law, without regard to conflict-of-law rules. Subject to nonwaivable consumer rights, disputes will be brought in the state or federal courts serving Lake County, Colorado. Before filing a claim, both sides are encouraged to attempt a good-faith resolution.

Precision Peaks may update these Terms prospectively. A new version and effective date will be shown here, and material changes will be presented before they apply to a new order.
